Stolen Gun Investigation Resulting in Accidental Shooting 'Pended', No Charges Filed

The stolen gun causing an accidental shooting that left one Fair Oaks teenager hospitalized with a gunshot wound to the chest doesn't appear to be under active investigation.

Sacramento Sheriff’s officials have not closed the case on an accidental shooting that sent one Fair Oaks teenager to the hospital two weeks ago with a gunshot wound to the chest, according to Sheriff’s officials.

In what is now being called a “pended” case, Sheriffs will not immediately be taking any further action on how three teenage boys came into possession of the stolen firearm resulting in the accidental shooting.

“If forensics on the gun come back and say something other than what the investigation yielded, we will visit that issue,” Sheriff’s representative, Jason Ramos said.

The report has since been turned over to the Sacramento County District Attorney’s office whereupon further findings in the report will determine what action, if any, will be taken.

“There’s no timeline on that, though, and no rush that we requested since we aren’t actively hunting any suspects,” Ramos said. “Quite honestly, since the victim didn’t die, there’s no ‘exigency’ that makes us request expedited testing results.”

District Attorney representatives were unable to provide any further details on the subject at the time of publication.

The shooting occurred at about 9 p.m. Feb. 8 on the 5600 block of Ritz Way and is described as an accidental shooting, inflicted by a known acquaintance of the victim, said Ramos.

Reports gathered indicate the boys were passing around a .357 revolver when the gun accidentally discharged one round. Sheriff’s deputies later found the stolen revolver wrapped in a white T-shirt in some bushes on the property.
