'We'll Never Get Over This,' the Victims' Mother and Wife Says of Deaths (Video)

Yanette Posca addressed reporters Friday afternoon following the involuntary manslaughter conviction of Marcos Costa, the truck driver who killed her husband and daughter in 2009 after the brakes failed on his big rig.

Holding a T-shirt with her daughter's picture beneath the words "In loving memory,'' spoke through tears to tell a bank of reporters that her family will never get over the deaths of and her , for whom she used his nickname "Jorge.''

"He took his little baby with him, but that’s OK, because I’d rather them be together than apart,'' she said in an emotional address to the media.

Posca's daughter and husband died instantly Apr. 1, 2009, when , having lost its brakes, smashed into their Ford sedan just north of bustling Foothill Boulevard. The car-carrying 18-wheeler rammed into other cars and injured three people before it crashed into the former .

A Pasadena jury on Friday acquitted Costa of two counts of murder, but found him guilty on the less serious charges of involuntary manslaughter, gross vehicular manslaughter and reckless driving.

The 10-man, two-woman jury deadlocked, however, on some allegations that could enhance his sentence: He faces a maximum of nine years in prison. Los Angeles Superior Court Judge Darrell Mavis declared a mistrial on those allegations. Deputy District Attorney said her office has not decided whether to re-try Costa on the enhancement allegations.

As for sentencing, defense attorney Edward Murphy said he will ask Mavis for probation. When Lugo addressed the media outside of court, she said she would be opposed to probation. The sentencing hearing is scheduled for Sept. 8.
