Man Shot by Oceanside Police Still in Hospital; Faces Attempted Murder Charge

A man shot by police Sunday shortly after he attacked his elderly mother in Oceanside remained hospitalized Wednesday but was expected to be released in time to make his first court appearance on Thursday, police said.

Gregory Foley, 56, will be arraigned on charges of attempted murder and resisting arrest at the Vista courthouse, Oceanside police Lt. Aaron Doyle said Wednesday morning.

Foley was armed with a knife and had failed to comply with numerous orders to drop his weapon when he was shot in the shoulder by an Oceanside police officer shortly after 6 p.m. Sunday, Doyle said in a statement.

The shooting occurred in the 4500 block of Milano Way, where police had been summoned by a 911 caller who said she had been attacked and was bleeding.

"A male voice was heard making threats to kill the 911 caller," Doyle said. "Officers responded and contacted an elderly woman with injuries reportedly inflicted by her adult son."

Less-than-lethal force was used without success before the officer fired at Foley, the lieutenant said.

Foley's mother remained hospitalized Wednesday but is recovering, Doyle said.

Doyle identified the lawman who shot Foley as Officer Corey Kaldenbach, a six-year veteran of the Oceanside Police Department. In accordance with department policy, Kaldenbach was placed on administrative leave following the shooting pending the outcome of an investigation. It was unclear when he might return to work.
