UPDATE: Playa del Norte Developer Sues City to Decertify Measure A Results

City Attorney Jeff Oderman reported on a closed session item at the San Clemente City Council meeting Tuesday night that Shaheen and wife Linda Sadeghi, along with staunch project supporter , filed a writ of mandate with the Orange County Superior Court April 8.
The filing asks the judge to throw out the results of the March 8 Measure A vote in which residents voted to scrap the 50,000-square-foot Playa del Norte retail project.

Oderman, explaining the contents of the suit, said the Sadeghis are alleging that the ballot title was misleading. It also questions the city attorney's impartial analysis. The suit also names the Orange County Registrar of Voters Neal Kelley, saying he did not include the full text of the Measure A ordinance or a message telling voters where to find the full text, among other procedural legal concerns.
"We don't think think the lawsuit has any merit whatsoever, and we will defend it," Oderman told reporters during a council recess.
