Solano County Man Gets Probation In Mother's Suicide

SOLANO COUNTY, CA — A Fairfield man who pleaded no contest to being an accessory after the fact in his mother's suicide last year was sentenced Wednesday to three years of probation and received credit for the time he served in jail during the prosecution of his case, Solano County prosecutors said. Eric Todd Capitanich, 44, called Vacaville police on Dec. 7, 2016 to report his 69-year-old mother was dead from a single gunshot wound to the head at Peabody Self Storage in Vacaville, police said.

The investigation determined Capitanich assisted his mother's suicide at her request, but his mother fired the gun, Lt. John Lydon said at the time.

Capitanich's mother had medical issues that created severe pain, Lydon said.

Capitanich moved from Vacaville to Fairfield before he was arrested in January 2017 for aiding or abetting a suicide.

An accessory after the fact charge can be filed as a misdemeanor or felony, and Capitanich was charged with a felony. He faced 16 months, two or three years in prison.

A Solano County Superior Court judge also ordered Capitanich to attend counseling or therapy as directed by the probation department, not to possess dangerous or deadly weapons or ammunition and the firearm used in the suicide was ordered destroyed, according to Solano County prosecutors.
