CT Business Owner Who Didn't Refund Customer Arrested: Cops

A patron of a pool installation company asked for their money back after their pool never came. The owner didn't send a refund, police said.

CANTERBURY, CT — The owner of a Canterbury pool installation company was arrested for failing to refund a customer after their pool never came, Connecticut State Police said.

Roy's Pools LLC owner Brian Roy, 40, of Sterling turned himself in to state police in Danielson on Monday, where he was charged with failure to refund payment for a home improvement within 10 days of a written request.

The charges stem from an incident that dates back to August 2020, when Roy's Pools agreed to install a pool at an unnamed customer's Connecticut home, police said.

The customer wrote a $7,086.69 deposit check, but reported to police that no pool was delivered and no work was done throughout August and September of that year.

Roy told the customer that the installation would be delayed to March or April of 2021 because of material delays, but on April 22, 2021, the customer got an email saying the installation would not be done, according to police reports.

On May 20, 2021, the customer mailed a "certified demand letter" to the business requesting a refund of the deposit, but the money was not refunded, police said.

A warrant was issued for Roy's arrest, and after turning himself in, he was processed without incident, held on a court-issued $10,000 bond and transported to the Danielson Superior Court for a same-day arraignment.

Police said they anticipate additional charges against him.
