Trumbull Woman Files 2nd Suit Over Trumbull Medical Office

A Plattsville Road resident and neighbor of a recently-approved Bridgeport Hospital outpatient cancer treatment center has sued the town for the second time.

Patricia Ann Tivadar, of 139 Plattsville Road, said the Planning and Zoning Commission violated Trumbull Zoning Regulations and Connecticut General Statutes and "based its decision on factors not contained in the record." Her property is 100 feet from the site.

The commission failed to consider the financial and practical impacts of the project, such as an increase in traffic and the "safety and convenience of surrounding neighbors and the general public.

The building will cause "severe flooding and storm water runoff."

Further, the "emission of noise, light and odors .... and traffic and parking congestion ... will result from the construction and development of the plan," the suit states.

The commission also failed to "make any findings that the proposed project would not have a negative impact on property values."

Numerous neighbors said at commission hearings that the building, part of which will be 45 feet high, would tower over the neighborhood and its appearance would reduce property values.

But Ray Rizio, the lawyer for the developer, disagreed and presented a statement from a local appraiser refuting that claim.

The project is expected to bring jobs and thousands of dollars and tax revenue to Trumbull.

The suit, which seeks to overturn the decision, was filed by Attorney Robert Rosati of Stratford.

Tivadar has also challenged the approval of the Inland Wetlands and Watercourses Commission regarding the project.
