Maynard Suffers "Breakthrough Seizure," Won't Be Charged in Accident

WATERFORD, CT - State Sen. Andrew Maynard will not be charged in the Jan. 14 car accident on Route 32 in Waterford, Waterford Police announced at a Feb. 23 press conference.
Waterford Police Chief Brett Mahoney released the following information on the accident, initially thought to be a one-vehicle accident. He said initial radio reports noted that one vehicle was involved in the accident, so he created a Facebook and Twitter post to that effect.
When police arrived on scene, Mahoney said two vehicles were involved and a new press release was sent out the next day.
Maynard of Stonington and Laury Benjamin-Scelfo of Uncasville, were involved in the accident. Maynard’s car was badly damaged and ended up down an embankment and he was taken to an area hospital.
Mahoney said there were no reports of liquor on the breath of either driver. He said Maynard was unconscious at the scene and no field sobriety tests were administered on either party.
Benjamin-Scelfo reportedly refused medical treatment at the scene, Mahoney said.
Three witnesses to the accident were interviewed and said it appeared that Maynard was suffering from some kind of physical distress, police said. His license was seized, pending the investigation.
Maynard’s Medical Records
Mahoney said Maynard’s medical records after the accident show that he suffered a breakthrough seizure at the time of accident. No alcohol was present in his blood and no drugs were listed, he said.
The Outcome
Waterford Police sent its investigation to the New London State’s Attorney office for an independent review, due to the high profile aspects of the case.
The New London state attorney’s office concurred with Waterford Police, Mahoney said. He said Maynard is an at-fault party but suffered a medical issue that caused the accident and therefore, he will not be charged.
“It [the case] is considered resolved,” Mahoney said.
