Response from Lt. J. Paul Vance: Yes, it is illegal, even if you are getting off on the next exit. The charge would be “Passing On The Right” and/or “Failure To Drive In Established Lane," both of which are infractions for $132 fines. A break-down lane is just that, a break-down lane for emergencies. It is not designed or intended for travel.
