Chandry Levy Murder: Charges Dropped for Man Awaiting Retrial

Ingmar Guandique was awaiting retrial in the May 2001 murder of Chandra Levy, a 24-year old intern who disappeared while jogging.

WASHINGTON, DC -- A man awaiting retrial in the death of intern Chandra Levy will go free, according to the U.S. Attorney's Office for the District of Columbia.

"Based on recent unforeseen developments that were investigated over the past week, the Office moved to dismiss the case charging Ingmar Guandique with the May 2001 murder of Chandra Levy," said a statement from the U.S. Attorney's Office.

Levy, a California native, was 24 years old and an intern with the Federal Bureau of Prisons when she disappeared in Rock Creek Park while jogging in 2001. Her remains were found a year later.

Guandique, 34, was convicted of killing Levy and sentenced in 2010 to 60 years in prison largely on testimony from a one-time cellmate who was reportedly trying to curry favor with prosecutors, The Washington Post reported at the time.

The case was further sensationalized at the time when investigators found that Levy had been having an affair with a married California congressman, Gary Condit who was cleared in the case.

The U.S. Attorney's office tells NBC News that once the charges are dropped, Guandique will be released to the custody of immigration agents, who will seek to deport him.
