Butler Back in Court Tuesday in Advance of Death Penalty Trial

Cory Butler is scheduled for another court appearance in Walton County Superior Court Tuesday, Feb. 5, 2013, according to Alcovy Circuit Court District Attorney Layla Zon. Butler is one of the three Monroe men accused in the 2009 murder of 65-year-old Epsie Ewing of Loganville. Butler is the first of the three scheduled to go on trial on March 13, 2013. All three are facing the death penalty.

"This is the final hearing (for Butler) that has been scheduled, but of course that could change if one is needed," Zon said. "This will be to address certain records in the state's possession from the Department of Corrections that the defense doesn't think the state should have - and to tie up loose ends." 

Butler, John Jody Blackwell, Jr. and Barry Partee are facing the death penalty following the May 21, 2009 attack that resulted in the death of Ewing the following month.

Earlier Zon said earlier that the trial would start with jury selection on March 13 and would then roll straight into the trial once the jury was seated.
