Fatal Crash In Aurora Leads To Reckless Homicide, DUI Charges
An Aurora man was charged with reckless homicide and DUI after a crash Sunday evening that killed his 29-year-old passenger, police said.

AURORA, IL — An Aurora man is facing a reckless homicide charge after police alleged he crashed his car into a tree Sunday evening while driving under the influence, killing his passenger.
Gustavo Gutierrez-Aguilar, 35, of the first block of Margarets Lane in Aurora, was also charged with six felony counts of aggravated DUI after being treated for his injuries, according to a news release.

Aurora police said they were called around 6:15 p.m. Sunday to the intersection of Mountain Street and Austin Avenue, where they found a man struggling to walk near a car that crashed into a tree.
A passenger, who was unconscious and not breathing inside the car when paramedics first arrived, died shortly after reaching a local hospital, police said. Police identified the passenger as 29-year-old Lazaro Rosas-Garcia, of the 1000 block of Rainwood Drive.

Gutierrez-Aguilar could not maintain his balance after the crash, and officers smelled a “strong odor” of alcohol coming from him, police allege. Police said they later determined Gutierrez-Aguilar’s blood-alcohol content was more than two times higher than the legal limit to drive.
Man Who Said He Was Timmothy Pitzen To Be Sentenced Tuesday
Gutierrez-Aguilar is being held at the Kane County jail in lieu of $500,000 bail. He is due to appear in court Thursday.
