ISP Sergeant On 'Restricted Duty' After McHenry County DUI Charge
Report said prosecutors have filed a motion asking the judge to reconsider his decision after the ISP officer got his license back.
CRYSTAL LAKE, IL — An Illinois State Police officer has been placed on restricted duty following a Feb. 1 arrest on accusations he was driving under the influence while off duty through Crystal Lake in an unmarked police vehicle, officials confirmed Tuesday, according to Northwest Herald. According to court records, Konie was charged in McHenry County with DUI (alcohol) following his arrest. Northwest Herald said the master sergeant with Illinois State Police Department received his most recent paycheck April 5, according to Illinois comptroller records.
Konie was placed on restricted duty immediately after his arrest, ISP Sgt. Jacqueline Cepeda said in a Tuesday afternoon email. His driver’s license was also temporarily suspended, but he now has it back, the news report said.
“The officer you inquired about has been placed on restricted duty and police powers are currently suspended pending the outcome of the internal investigation, and court proceedings,” Cepeda wrote in the email, according to Northwest Herald.

McHenry County Judge Mark Gerhardt ruled that police didn’t have reasonable grounds to believe that Konie was under the influence of alcohol when they made the arrest, after Konie's attorney Edward Donahue requested to repeal Konie's license suspension last month, Northwest Herald said. The news report added that the state’s attorney’s office will argue its case Thursday in court as prosecutors have filed a motion asking the judge to reconsider his decision.
