More Charges Filed In Kidnapping, Sex Assault Case

Additional charges have been filed and a warrant has been issued for a man who was released from jail after police say he kidnapped his ex-girlfriend in Cary and sexually assaulted her.

David Silva, 36, of the 300 block of West Green Meadows Boulevard in Streamwood, was initially charged with one count of kidnapping, one count of unlawful restraint and two counts of domestic battery.

Court records show Silva has now also been charged with aggravated kidnapping inflicting harm, aggravated domestic battery by strangulation, intimidation by physical harm and aggravated battery in a public place.

Cary Deputy Police Chief Scott Naydenoff said a woman came into the Cary Police Department around 11 a.m. July 29 to report the incident.

Naydenoff said the woman’s ex-boyfriend, identified as Silva, contacted her and lured her to his place of employment in Cary to retrieve money for their child.

The woman drove to the business and exited her vehicle. She learned Silva was waiting for her in his vehicle.

Naydenoff said that Silva forced the woman into his vehicle as she approached it.

Silva then drove the victim to a hotel in Hoffman Estates where he led her to a hotel room.

Silva sexually assaulted the woman inside the hotel room and then drove her back to her vehicle in Cary, Naydenoff said.

Officers received a report around 6 a.m. Friday that Silva showed up at his place of employment in the 200 block of Jandus Road in Cary.

Management called the police because Silva was no longer permitted to be on their property.

Silva left the business in a vehicle before officers arrived. A short time later they located Silva in a parking lot of a business in the 100 block of East Main Street in Cary.

The man was taken into custody and transported to the McHenry County Jail.

During a bond hearing, Assistant State’s Attorney Ken Hudson said the victim alleged that Silva threatened to kill her if she reported the incident to police.

Hudson asked McHenry County Judge Jeffrey Hirsch to impose a $75,000 cash bond for Silva, calling the incident “extraordinary circumstances.”

Silva’s public defender asked the judge for a bond “Silva can post, if not for him to be released on his own recognizance.”

Hirsch allowed Silva to be released on a personal recognizance bond, which is where a defendant is released without paying any money.

There remains an active warrant for Silva’s arrest following the additional charges being filed, court records show.

The Cook County State’s Attorney’s Office is reviewing the case to determine charges for the sexual assault in Hoffman Estates, Naydenoff said. It is unknown if those charges have been filed yet.
