Controversial 'Five Corners' Gas Station Plan Nixed By Judge
The ruling comes after several months of legal battles, protests, and debate.
GLEN ELLYN, IL — After close to two years of legal proceedings and protests, a judge has ruled against the village of Glen Ellyn's proposal to build a gas station at the intersection of Main Street, Geneva Road, and St. Charles Road. DuPage County Circuit Court Judge Bonnie Wheaton handed down a six-page ruling that called the special use permit for the gas station "arbitrary, capricious, against the manifest weight of the evidence," Daily Herald reports.
In her decision, Wheaton cited the proposed project's proximity to Forest Glen Elementary School. She mentioned that the village did not present evidence on how the gas station would affect the 600 students at the school, which is located 300 feet from the property.
Wheaton said, "Surely the health and safety of 600 children is worthy of at least cursory consideration by the Village Board."
