
A 25-year-old Wisconsin man was so intoxicated that he wouldn't leave Jimmy Johns and couldn't seem to understand his rights, when Ames police asked him to take a chemical test, according to criminal complaints.
Ames Police went to Jimmy Johns on Welch Avenue about 2:30 a.m. Feb. 22 after someone called and said an intoxicated man refused to leave, complaints said.
The officer had to shake the man several times to wake him, because he was sleeping in a booth, complaints said. The officer wrote that he smelled like an alcoholic beverage, spoke with slurred speech, had bloodshot watery eyes and appeared to be disoriented, complaints said.

The man told police that he knew where he was, but was unable to say where and police weren't able to perform tests because the man was unable to track the officer's finger, complaints said.
Tyler Polson was then placed under arrest and taken to the police department where he was read his notice of right to a chemical test, according to complaints. Polson kept asking what would happen if he didn't sign the form and police said it was his right to decide whether to take the test, complaints said. After Polson spent 10 minutes reading the form, police said they needed an answer, when Polson didn't give one the officer marked “refuse,” and Polson was taken to the Story County Jail, complaints said.

Joshua Stewart, 22, Stanton Ave., was charged with possession/delivery of marijuana at 10:30 a.m.
Feb. 22
Brendan Best, 22, Burnett, was charged with public intoxication at 11:59 p.m.
Daniel Brass, 26, Iowa Falls, was charged with operating while intoxicated, first offense at 1:55 a.m.
Tad Duhn, 29, Mulberry Blvd., was charged with second-degree harassment at 3 p.m.
Erin Fosselman, 21, Mortensen Road, was charged with public intoxication at 1:22 a.m.
Arthur Heldt, 19, Beach Ave., was charged with failure to use headlamps when required and operating while intoxicated, first offense; at 1:04 a.m.
Terrance Jenkins, 23, S. 16th Street, was charged with criminal trespass and fifth-degree shoplifting at 5:45 p.m.
Tyler Polson, 25, Wis., was charged with public intoxication at 2:40 a.m.
Zachary Torpy, 19, Stanton Ave., was charged with public intoxication at 1:30 a.m.

Matthew Pavlicek, 23, Friley Road, was charged with disorderly conduct at 2:24 a.m.
Feb. 24
Ralph Ellis, 54, Duff Ave., was charged with driving under suspension, unlawful possession of a prescription drug and operating while intoxicated, first offense; at 12:13 a.m.
George Solheim, 47, West Street, was charged with driving under suspension, operating while intoxicated, first offense; and possession of drug paraphernalia at 6:39 p.m.
