Cedar Rapids Man Charged With Sex Abuse, Showing Obscene Material to 11 Year Old

A Cedar Rapids man has pleaded not guilty to inappropriately touching an 11-year-old boy and showing him obscene material in Marion over the course of 10 months.

Danny Allen Yanecek, 54, 5603 Wilder Drive SE in Cedar Rapids, was charged with second-degree sexual abuse and exhibiting obscene material to a minor at 11:45 a.m. on Feb. 8 at 2274 Fifth Ave.

Yanecek "intentionally touched the penis of an 11 year old male on more than one occasion," according to a Marion Police criminal complaint. He also showed the 11 year old boy "photos of naked persons in magazines," according to the complaint for the second charge.

Yanecek pleaded not guilty to the charges last week. He does not have a listed number and could not be reached for comment.

A pretrial conference is scheduled for May 30 at 11 a.m., and an order for a trial has been issued for June 10 at 9 a.m. 

The incidents occurred between May 2012 and Feb 2013. The alleged sexual abuse occurred "on or around the property of Lacey Plumbing and Marion 4WD." Lacey's is located at 2274 Fifth Ave., but Marion 4WD does not have a listed address. These locations are both in Marion.

Second-degree sexual abuse is a Class B felony, and exhibiting obscene material to a minor is a serious misdemeanor. A Class B felony is punishable by up to 25 years in prison.

According to Iowa Code, second degree sexual abuse occurs when:

1. During the commission of sexual abuse the person displays in a threatening manner a dangerous weapon, or uses or threatens to use force creating a substantial risk of death or serious injury to any person.
   
2. The other person is under the age of twelve.
   
3. The person is aided or abetted by one or more persons and the sex act is committed by force or against the will of the other person against whom the sex act is committed.
