Accused Foxborough Fentanyl Dealer Gets Bail

A judge in U.S. District Court in Boston has allowed Stephan Pena to be released on $25,000 bond.

BOSTON, MA — A man who was arrested on serious drug charges in Foxborough has been granted bail.

A judge in U.S. District Court in Boston has allowed Stephan Pena to be released on $25,000 bond. Once he is out of jail, he must live with his mother in Meriden, Connecticut, be monitored by GPS, and only travel for legal and medical appointments, according to court records. While he will not be forced to give up his passport, Pena's attorney must provide a written notice of the changes and conditions to the consulates of the Dominican Republic, where he has ties, to prevent Pena from obtaining a new passport.

Pena was arrested during the early hours of Nov. 3 at the Lodge at Foxborough on Foxborough Boulevard for a report of a disturbance at the building. Pena told police that his cousin and his girlfriend were fighting and attempted to close the door to his apartment on the officers, according to a police report. When Officer James Cannata attempted to block the door and enter to check on the two who were arguing, Pena allegedly yelled "They are coming in" in Spanish. When police tried to arrest him, he allegedly assaulted them and tried to flee up the stairs.

Once Pena was placed in police custody, officers checked the second floor and allegedly found several 55-gallon drums, a baby highchair, diapers, a large pan on a stove top, and several bottles of bleach. Officers also discovered an open door to the patio and it appeared that whoever was on the second floor had fled. The other people inside the house were not located.

More than 1,000 grams of fentanyl was found during a search of the apartment.

Prior to his release, Pena had been in federal custody since Dec. 14, according to court documents.

Pena has been charged with possession of fentanyl with intent to distribute and possession of more than 40 grams of fentanyl. He faces up to 20 years in prison.
