Haverhill Woman Indicted in Fatal Badger Road Crash

Brooke Uttley, 22, indicted in on charges of vehicular homicide in the December 2011 death of Ashley Donahue, 20; both were students at Framingham State University.

Brooke Uttley, 22, of Haverhill, was indicted by a Middlesex County grand jury on charges of motor vehicle homicide, operating to endanger, and operating a motor vehicle while under the influence of alcohol causing serious bodily injury.

An arraignment date has not yet been set. 

According to authorities, on   Upon arrival, investigators observed a Honda Civic facing the north bound direction with significant damage.  The air bags in the vehicle had been deployed and the vehicle’s rear window was completely shattered.  The motor vehicle was unoccupied and it was determined that this was the only vehicle involved in the crash and that it had struck a telephone pole.

While on scene, investigators were notified that three occupants who were in the motor vehicle were inside a nearby residence.  They were located and transported to where they were treated for their injuries.  One of the three victims sustained serious injuries which affected her mobility and caused her to lose vision in her right eye.

Also on scene, authorities located the defendant, who was in the woods behind a tree.  Officers observed that the defendant was allegedly unsteady on her feet, her eyes were blood shot and there was an odor of alcohol coming from her breath.  She was transported by MedFlight to Massachusetts General Hospital where she was treated for her injuries.

A short distance from the defendant, authorities located , 20, of Bridgewater, evidencing obvious injuries.  She was pronounced dead at the scene.  

Authorities allege that the defendant and the four victims were at the defendant’s apartment in Ashland prior to the crash.  It is alleged that the defendant consumed alcoholic beverages before driving the victims back to where they lived on campus.  While driving to campus, it is alleged that the defendant was speeding at approximately 65 to 75 miles per hour in a 25 miles per hour zone when she struck the telephone phone, which resulted in the victim, Ashley Donahue, and a second victim being ejected from the motor vehicle.  The defendant’s blood alcohol level shortly after the crash was determined to be .10%.

The defendant was cited on Dec. 16 for felony motor vehicle homicide and operating a motor vehicle while under the influence of alcohol causing serious bodily injury and summonsed for arraignment.  

She was arraigned in on Dec. 21, 2011 where Judge Robert Greco ordered the defendant released on conditions that she stay away from the victims and the families of the victims, refrain from the use of alcohol, ordered to submit to random screens for alcohol, and ordered not to operate a motor vehicle between the hours of 8 p.m. and 6 a.m. if her license is reinstated, subject to the actions of the Registry of Motor Vehicles.  

These charges are allegations, and the defendant is presumed innocent until proven guilty.
