5. CONSENSUS MOTIONS 


a) Approve issuance of a 2012 Natural Tree Sales License to Bork Evergreens LLC to sell at 7053 – 10th Street (Rainbow Foods parking lot). 


b) Waive reading and adopt Resolution No. 2012-   , Approving deferral of special assessments associated with City Project No. 2012-01 (2012 Street Reconstruction Project). 


c) Approve the renewal of the Pawnbrokers License for Twin City Pawn, 1021 Geneva Avenue. 


d) Approve issuance of a Massage Therapy License to Donna Marie Boyd to practice at Peaceful Waters Wellness Spa, 7300 Hudson Boulevard, Suite 220. 


e) Approve the renewal of the Massage Therapy License for Sarah Jane Schwartzbauer Cooley to practice at The Oaks Office Park, 7755 – 3rd Street. 


f) Approve entering into a cooperative agreement with the State of Minnesota through the Minnesota Department of Natural Resources regarding the property in the northwest corner of Highway 36 and Hadley Avenue on the Gateway State Trail/City of Oakdale Informational Sign. 


g) Approve the purchase agreement between the City of Oakdale and Peter Taubenberger for the acquisition of 5.33 acres of property at 3301 Geneva Avenue for $75,000, and appropriation of up to $40,335 from the Open Space Acquisition Fund to cover up to 50% of the cost of acquisition. 


h) Waive reading and adopt Resolution No. 2012-   , Calling for a public hearing on the modification of the tax increment financing plan for Tax Increment Financing District No. 1-6 for November 27, 2012, at 7:30 p.m.  (Echo Ridge). 


i) Approve the Continuing Affordable Senior Housing Agreement between the City of Oakdale and Presbyterian Homes and Services (Echo Ridge). 


j) Waive reading and adopt Resolution No. 2012-   , Adopting the Paid Time Off/Annual Leave Policy, effective October 23, 2012, and directing staff to bring further guidelines forward in 2012.

b) Zoning Ordinance Text Amendment – Permitted Uses in the Community Commercial Zoning District (Recommendation:  Waive reading and adopt Ordinance No. _____, Amending the Code of Ordinances, Chapter 25 – Zoning, Section 25-74(a) to allow pawnshops, precious metal dealers, and day care centers as permitted uses in the C-2 (Community Commercial) zoning district; approve summary publication).  (PRESENTER:  Ridlon) 


c) Vein Clinic/Alsara Properties LLC – Site Plan and Variance (Recommendation:  Waive reading and adopt Resolution No. 2012-   , Approving the site plan for the property at 6211 Upper 51stStreet, including a 10-foot variance to the north parking lot setback and a 5-foot variance to the west parking lot setback, in order to expand the existing parking in the northwest portion of the site, subject to the applicant removing the existing Cottonwood trees at the northwest corner of the site and replacing them with two Amur Macckias or similar species, as approved by the City Forester).  (PRESENTER: Ridlon). 


d) Little Minds Day Care Center/WB Properties LLP – Minor Subdivision and Site Plan (Recommendation:  Waive reading adopt Resolution No. 2012-   , Approving the minor subdivision and site plan for Outlot A, Oak Marsh Commercial 2nd Addition, to provide for a 7,700 square foot day care center).  (PRESENTER:  Ridlon)

HEARING (may begin at or any time after 7:30 p.m.) + Assessment Hearing – Unpaid Noxious Weed/Mowing and Utility Bills (Recommendation:  Waive reading and adopt Resolution No. 2012-   , Certifying outstanding utility and noxious weed removal accounts to Washington County for inclusion on property taxes).  (PRESENTER: Warren). + Oak Meadows – Conduit Bond Refunding (Recommendation: Waive reading adopt Resolution No. 2012-   , Supporting the issuance of revenue bonds to finance a senior housing project (Oak Meadows Project), pursuant to Minnesota law.(PRESENTER:  Warren).
