Monday's Council Agenda: Delmar Gardens, Westboro Baptist Church & Fozzie's

Monday night, Creve Coeur's City Council will have the first chance to officially discuss the Delmar Gardens rezoning and development plan for Ladue Road. The project, which received a negative recommendation from the city's Planning and Zoning Commission, is scheduled for a first reading at the meeting, which starts at 7 p.m. at the Creve Coeur Government Center.

As Patch reported Friday, Delmar Gardens officials have requested a 3 month delay for city proceedings related to the project. That time, Delmar Gardens executive Howard Oppenheimer wrote in a letter to council, is necessary to address questions raised by Planning and Zoning members. Residents near the proposed development have also filed a protest over the plan, which would make it more difficult for the project to gain Council approval.

Several P&Z Commissioners said when they gave the negative recommendation that even though they liked the idea, the project was inconsistent with the city's Comprehensive Plan. At least two said even with an update of the Comprehensive Plan which guides zoning decisions, coming at some point, it would not change enough to allow for the Delmar project.

Oppenheimer told Patch Friday it was "premature" to answer how the Comprehensive Plan or Delmar Gardens' proposal might be different in three months time.

Also on Monday's agenda:

• First reading on an ordinance that would place limits on funeral protests, mirroring a law on the books in Manchester to address protests conducted by groups like the Westboro Baptist Church.

• Council members will also give first reading on a pair of conditional use permits for an Indian restaurant and a Fozzie's Sandwich Emporium looking to expand into Creve Coeur. Emergency clauses have been built into both permits because the council will not hold another regular meeting in December.
