Oakville Man May Face Additional Charges in Death of Desoto Man
St. Louis County prosecutors say they may bring additional charges against Patrick Rayburn before a grand jury on June 12.
An Oakville man may face jail time after he hit and stomped on the head of a Jefferson County man who later died from injuries relating to the attack.
St. Louis County prosecutors on Friday charged Patrick Rayburn, 44, of the 300 block of Susan Road in Oakville, with first-degree assault resulting in a serious injury.
Dustan Marler, 34, of DeSoto, was attacked in August 2012 and later died on Oct. 25, 2012 after his brain hemorrhaged from a hematoma suffered in the attack.

Charges may be added when the case is presented to a St. Louis County grand jury on June 12, an official from the St. Louis County Prosecuting Attorney’s Office said. The official could not say what additional charges will be brought to the grand jury.
The official said the night Marler died, he was out drinking with a friend. He had gotten drunk and also used synthetic drugs that are marketed as bath salts, the official said.

A St. Louis County coroner reported the case couldn't be ruled a homicide because the coroner didn’t know what may have caused the hematoma to re-open and begin bleeding again. The prosecuting attorney's office will investigate what caused the bleeding to resume in Marler's brain, an official said.
However, the hematoma was caused by the Aug. 26 attack, according to court documents.
St. Louis County Police said Rayburn struck Marler and then stomped on his head until he lost consciousness at Rayburn’s home in the 300 block of Susan Road in Oakville.
Marler needed multiple stitches to close wounds and had scarring, according to a court document.
Rayburn is being held in the St. Louis County Justice Center. Bond was set at $75,000.
