Man Charged in Kohl's Theft Also in Trouble for Driving
A certified habitual offender, Jody Simms Jr. shouldn't have been behind the wheel leaving the scene of the crime.

Jody Simms Jr., age 36, of 146 Karatzas Avenue, Manchester, was arrested March 22 at 2:30 a.m. on an arrest warrant charging him with theft by
unauthorized taking or transfer, a class A misdemeanor.
In addition, he was subsequently charged with driving while being certified as a habitual offender, a class B felony, and driving without giving proof of financial responsibility, a class A misdemeanor, after he drove from the scene of the alleged crime.
On February 12, 2013 at approximately 10 p.m. members of the Nashua
Police Department’s Uniform Division responded to Kohl’s at 21 Gusabel Avenue in Nashua in reference to a theft in progress involving a male and female suspect. Prior to police arrival the male fled operating a vehicle. Jody Simms Jr. was identified as the suspect in the theft and an arrest warrant was issued for him. A subsequent records check confirmed his license status was suspended as he was certified as a Habitual Offender and that he was required to give proof of financial responsibility.

The Habitual offense is punishable by up to five years imprisonment, exclusive of fines. The misdemeanor offense is punishable by up to a year in jail, exclusive of fines. Simms was being held on $1,000 cash or surety bail and was scheduled to be arraigned in the 9th Circuit Nashua District Division Court on March 25, 2013.
