Need a Refund from Bankrupt Pierre Deux? Here's How

Employees and customers owed money by the popular Millburn retailer have until Oct. 5 to file claims with the court.

As on Patch, Pierre Deux has closed its doors in Millburn and its 22 other US stores, and has now made provisions for employees owed money and customers who paid deposits towards orders.

The home furnishings and specialty retailer, owned by Secaucus-based Arts des Provinces de France Inc, held assets of $12.1 million and debts of almost $54 million. The company filed bankruptcy and filed to liquidate assets on June 23, in U.S. Bankruptcy Court in Newark.

According to the letter posted on the company website, creditors have until Oct. 5 to file a claim. Employees, and customers who placed deposits for orders have particular instructions:

  1. Former employees of the company may be entitled to a priority claim not to exceed $11,725 for unpaid wages, salaries and commissions, including severance, vacation and sick pay, and unpaid contributions to any employee benefit plan, earned or arising from services rendered within 180 days of the Debtor's petition.
  2. Individuals who placed with the Debtor a deposit on goods or services purchased but not delivered by the Debtor on or before the date of the bankruptcy petition may be entitled to a priority claim in an amount not to exceed $2,600. If such a deposit was made with a credit card, you may wish to contact your credit card servicer and request an appropriate credit to your account at this time.

A trustee, lawyer Steven Kartzman of Morris Plains, N.J., has been named by the court to oversee the Arts des Provinces de France liquidation process. Kartzman said in the legal filing that the value of the company's assets was unknown.

Calls to the Millburn store, which is closed but not vacant, were not returned.
