Amalia Mirasola was indicted on murder charges by a grand jury in March 2011.

Mirasola's attorney, Kalman Geist, told a judge during pre-trial proceedings in November that the woman felt threatened by her husband. The attorney said Carl Mirasola had been taking disability checks from his wife and seeing a girlfriend.
