Report: Bahr Lumber Site Construction Agreement Reached

Attorney representing Durrell Street residents says parties, developer reach accord, declines to discuss terms.

When the Verona Planning Board gave final approval to a plan to build condominiums on the Bahr Lumber & Hardware site on Durrell Street on Aug. 23, 2012, a group of Durrell Street residents filed a lawsuit against the ruling.

The residents claimed the approval was illegal, citing the township’s authority to change the zoning of the site from commercial to residential, overcrowding of schools and traffic issues.

Caldwell attorney Michael Rubin, representing the residents, said in a Saturday NorthJersey.com report an agreement has been reached between the developer and the parties, although he declined to discuss what the agreement entailed or when the agreement will be finalized.

"There are so many people involved and each of them needs to take the proper steps," Rubin told the publication.

Until then, the planning board's decision is stayed, according to Verona Township Engineer Jim Helb.

The Lennar Corporation proposal called for the construction of 33 units of two-bedroom/one-car garage townhomes on the site at 37-47 Durrell St.
