City Council Agenda Sept. 8: 'Best Value' Contracts, Remove 'Fiscal Crisis’ Designation

The following is the agenda for the Long Beach City Council’s Sept. 3 meeting:
1. Ordinance to Amend the Code of Ordinances of the City of Long Beach

Legislative Memo: The City desires to increase the fines within multiple
dwellings with less than 25 dwelling units to a maximum amount of

$1,000 for each day on which the violation exists. A multiple dwelling is
defined by the City Code as a building containing three (3) or more
dwelling units occupied exclusively for residential purposes.
2. Ordinance to Amend the Code of Ordinances of the City of Long Beach
Re: Administration – Purchasing and Procurement.
Legislative Memo: New York State General Municipal Law was recently
amended providing municipalities the enhanced ability in the awarding of
contracts on the basis of “best value”. Best value is a common sense
update for awarding contracts for services to the bidder which optimizes
quality, cost and efficiency. Best Value takes into consideration such
areas as how well the product or service provider performs, life-cycle
costs (what it will cost to operate or maintain the product for 5, 10, 15, or
20 years), and environmental impacts The City’s Procurement Policy and
Procedures is being amended as well.
3. Resolution Amending and Reaffirming the Procurement Policy and
Procedures of the City of Long Beach.
Legislative Memo: The City periodically reviews this Policy and makes
amendments pursuant to General Municipal Law. This review is to be
performed annually. This item works in conjunction with Item 2 above.
4. Resolution Granting Waiver of Off-Street Parking Requirements Re:
Premises: 78 East Park Avenue (street floor), Long Beach, New York.
Re: Kiosk for Drop Off/Pick Up Services for Dry Cleaners,
Wash & Fold and Shoe Repair
5. Resolution Authorizing the City Manager to Enter into a Contract for the
Reconstruction of Grand Boulevard (between W. Park Avenue and W.
Beech Street) with the Lowest Responsible Bidder.
Legislative Memo: Grand Boulevard is a major thoroughfare for trucks
and buses to get into the West End of Long Beach and is in need of
repairs. This much needed reconstruction is being 100% funded by the
New York State Department of Transportation CHIPS (Consolidated Local
Street and Highway Improvement Program). CHIPS funding pays for
transportation oriented repairs to roadways.
6. Resolution Removing the February 7, 2012 Fiscal Crisis Designation as
the City of Long Beach has Entered into Long Term Fiscal Recovery.
Legislative Memo: On February 7, 2012, the City Council declared a
fiscal crisis and directed and empowered the City Manager to implement
enhanced budget discipline and budgetary relief to assist the City in
returning to fiscal stability. As directed by that Resolution, the City
Manager has implemented and achieved Spending Control Policies and
Procedures; Fiscal Accountability Policies and Procedures; Personnel
Savings Policies and Procedures and as a result the City Council passed
balanced budgets for the 2012-2013 and 2013-2014 fiscal years. As such
it is now appropriate to remove the “Fiscal Crisis” designation, enter the
long term recovery phase and put forth a long term financial recovery
