Cortlandt Man Charged with Narcotics Trafficking in Philipstown

A Cortlandt man sold oxymorphone pills to an undercover deputy, police said.

A Cortlandt Manor man was arrested for allegedly selling narcotics at various locations in Philipstown after selling illegal pills to an undercover police officer, the Putnam County Sheriff’s Department reported today.

In June 2011 an undercover deputy from the Sheriff’s Narcotics Enforcement Unit learned that John Magner, 32, of Dogwood Road, was selling prescription pain medication to people in Continental Village and Philipstown. The undercover dputy infiltrated Magner’s enterprise and purchased oxymorphone pills from him on two separate occasions.

On Jan. 20, 2012, narcotics deputies observed Magner sitting in a car in Putnam Valley. They stopped the car and took Magner into custody. A search of him and his car produced additional oxymorphone pills secreted inside a household cleaning container.

Magner was charged with two counts of Criminal Possession of a Controlled Substance in the Third Degree, two counts of Criminal Sale of a Controlled Substance in the Third Degee – those being class “B” felonies and Criminal Possession of a Controlled Substance in the Seventh Degree, a class “A” misdemeanor.

He was arraigned before Putnam Valley Town Justice Louis DiCarlo and remanded to the Putnam County Correctional Facility in lieu of $50,000 cash bail. Magner was later released after posting the required bail.

Additionally, narcotics officers seized Magner’s 2001 Buick.  It is being held pending asset forfeiture proceedings.

If convicted of any count of the felony charge he is facing, Magner may be sentenced to a term of incarceration for up to nine years in a New York State correctional facility as determined by a court.
