The village resident's attorney said he would not seek a hardship license and turned over his driver's license to the court Wednesday.
Because Marvin's attorney said his client sought an evaluation through an Office of Alcoholism and Substance Abuse Services (OASAS)-certified provider, Village Justice Fred D. Weinstein did not refer him to Treatment Alternatives for Safer Communities (TASC).

The case was adjourned until April 10 for a possible disposition.
Sanchez Sentenced in Irvington, Waiting on Ossining Disposition
DWI Defendant Norman Sanchez appeared in court Wednesday, but will likely be waiting at least a few more weeks for a disposition.
His attorney said he was recently sentenced in an Irvington case to eight months incarceration and is currently being held at Westchester County Jail.
Sanchez, 25, is also due in Sleepy Hollow Court on Monday, he said, where a sentence will likely run concurrent with Irvington.
A third docket open in Ossining is still yet to be resolved and the outcome of the Briarcliff Manor matter may be connected to the Ossining disposition, per Assistant District Attorney Christopher Daniele.
The Briarcliff Manor matter was adjourned to April 10. Weinstein said Sanchez's Briarcliff Manor bail status will continue at $1,000 cash or bond.
Alleged Drunk Motorcyclist Starts TASC
Ivan Galindo, an Ossining resident accused of driving while intoxicated after being involved in a motorcycle accident in September, recently started a TASC treatment program, according to his attorney Wednesday.
The 37-year-old's attorney requested a one-month adjournment in the case to allow time for the procedure's results to be shared with the court.
Galindo is due back on April 24.
Disposition Soon Likely for Stich
Walter F. Stich, 49, appeared to answer to a Driving While Intoxicated Charge stemming from a Nov. 17, 2012 arrest.
The Newtown, CT, resident received a favorable TASC report recently, according to Weinstein. Daniele said he does not plan to offer a reduced plea in the case.
The case was adjourned until May 8 for an anticipated disposition.
DWI Defendant's License Suspended
Luis V. Torres of Ossining, arrested on March 16, is charged with Driving While Intoxicated.
The 48-year-old man entered a plea of not guilty through his attorney at his arraignment Wednesday. His attorney noted Torres had seen an OASAS-certified doctor and asked the court not to refer him to TASC.
After some discussion, Weinstein said he would not refer Torres to TASC, but asked his attorney to forward the report from the doctor as soon as possible.
Torres surrendered his license, which is suspended during the judicial process.
The case was then adjourned to April 10.
