Cell Tower Proposed in Bath Township
Township has little say in where antennas go

A company is seeking to build a cell phone tower at 525 N. Cleveland-Massillon Rd., near the intersection of Embassy Parkway.
Township Administrator Vito Sinopoli said the property is owned by the Marchetta Co. in Bath Township.
Sinopoli said the township has little authority to regulate cell towers through its zoning laws, although officials -- and nearby residents -- can file an objection.

A person seeking to construct a tower in a residential area must send certified mail notice to property owners who live contiguous to and across the street from the site, as well as to the board of trustees.
The parties then have five days to file objections to the size or location of the tower.

But the township's hands may be tied.
"Generally, Ohio law provides no authority for a township to regulate, through zoning, the location or size of a cell tower," he said.
The company has not yet filed an application to construct a tower with Zoning Inspector Bill Funk.
