Bill Banning THC Products in Texas Stalls in Second Legislative Session, THC Remains Legal for Those Over 21

Hemp-derived THC products are still legal in Texas for now, but a separate bill was passed, making THC vapes illegal in the State of Texas.

Austin, Texas – /LaGuardia Media and Public Relations/ – On last Wednesday, September 3, 2025, Lt. Gov. of Texas Dan Patrick announced on social media that the bill banning THC “will not make it out of the special session”, according to CBS News.

The decision whether or not to criminalize the possession, distribution, and sale of products containing THC has been discussed since 2019, ever since “bad actors have taken advantage of a loophole in Texas agriculture law to sell potent, intoxicating forms of THC that have nothing to do with agriculture” according to Sen. Charles Perry.

The bill has undergone a sort of metamorphosis; going from Texas SB3 (which was vetoed by Gov. Greg Abbott, citing its unconstitutionality), to SB5 (which passed with bipartisan support) and now to having failed to advance in the special legislative session.

Texas business owners have been on the front line of this fight to squash these bills and save thousands of businesses in the Lone Star State. Trippiez Smoke Shops, located in the capital city of Austin, Texas sent this message out to its email subscribers:

“This was a collective effort”, states Ahmad Alnajjar, owner of Trippiez Smoke Shop. “I couldn’t be more proud of organizations like the Texas Hemp Business Council or Hometown Hero, who were instrumental in leading the way to us having this victory.” He continues: “The battle is won, but the war is not over. We wish to be involved in actually crafting this new regulation.”
Even though hemp-derived THC products are still legal in Texas for now, a separate bill aimed at cannabinoid vapes was passed, making THC vapes illegal in the State of Texas.
