Man Charged With Murder in East Austin

The man approached police and told them he might have killed someone.

It was just before 4 a.m. on Monday when a man responded to a call about a suspicious person at 714 E. 8th St. The man told them he had just been involved in a fight and might have killed someone.

The man, 67-year-old James Miller, led police to a house on the 1100 block of Navasota Street.

“Officers looked through a window and observed the body of a white male lying on the floor. Officers made entry into the home to check the welfare of the victim; however, no pulse was detected,” Austin Police Department officials said.

The victim was identified as 32-year-old Daniel Spencer. Miller was taken into custody at the Travis County Jail and charged with murder. His bond has been set at $250,000.

According to the arrest affidavit, obtained by KXAN, Miller told police that the two were hanging out when things got out of control.

“We were playing. We were doing the good music. We were playing back and forth and everything and I just let him know- Hey, I’m not gay. We been playing. We’re musicians and all that kind of stuff, but I’m not a gay guy. Then it seemed like everything was alright and everything was fine. When I got ready to go- it seemed like [expletive] just started happening,” Miller said.
