Man Charged With DWI After Fatal Crash On Loop 610

Jacob Austin Emery​, 27, has been charged with driving while intoxicated, but was not charged for the crash, according to police.

HOUSTON — A Houston man who was involved in a fatal crash Sunday morning was legally intoxicated, according to police. Jacob Austin Emery, 27, has been charged with driving while intoxicated, but according to the Harris County District Attorney's Office Emery didn't cause the crash and won't face felony charges.

The crash happened just before 2 a.m. at 8500 West Interstate Highway 610 South on Jan.20. According to investigators, a white Lexus 300 had become disabled in the northbound lanes of Loop 610 after being involved in a crash, and was rear-ended by a silver Ford Taurus.

The impact caused the Lexus to swerve to the left where it was struck by a black Ford F-150 pickup truck, driven by Emery.

The Lexus hit a concrete barrier after being hit by the Ford F-150. The driver of the Lexus died at the scene, while the female passenger was taken to Memorial Herman Hospital where she later died.

Officials said Emery was intoxicate at the time of the crash, and he was arrested. The identities of the two killed in the cash have not been released.
