Former Death Row Inmate Sues Houston, Harris County

Alfred Dewayne Brown was convicted of murder in 2003 and freed in 2015.

HOUSTON, TX — A man who spent more than a decade on Death Row has filed a civil rights lawsuit against Houston and Harris County, claiming that police and county officials concealed evidence and violated his rights to a fair trial and due process.

Alfred Dewayne Brown, who is now 35, was convicted in 2003 of capital murder in the shooting death of Charles Clark, a police officer. An appeals court overturned his conviction after phone records support his alibi was found in a homicide detective's garage. In response, Devon Anderson, the Harris County District Attorney at the time, said that she was not in possession of evidence sufficient to retry Brown; however, she did not declare him innocent.

Anderson's stance has been at the center of Brown's campaign to be compensated — he's seeking nearly $2 million — and his attorneys filed the civil suit as a way of speeding the process.

"This filing is the final chapter of Alfred Dewayne Brown's quest for justice after 12 years and 62 days of wrongful incarceration because of the defendants' conduct," Brown's Houston attorney, Gwen Richard, told the Houston Chronicle.

As part of the case, Brown's legal team has asked Kim Ogg, the Harris County district attorney, to decide if their client is innocent and therefor entitled to the monetary award.

A fund established for Brown on Generosity.com has raised more than $6,800 thus far.
