Charges Sought Against Shooter and Man Who Hosted Party

Shots barely missed hitting two men after fight broke out at a party.

Charges are being sought against one man suspected of hosting a party where he allegedly sold 'hits' of nitrous oxide, and another man who shot at two partygoers.

No one was injured during the incident and the names of the men are being withheld until formal charges have been filed.

Officials with the Caledonia Police Department have recommended to the Racine County District Attorney's office that the man who hosted the party be charged with possession with intent to distribute or deliver nitrous oxide, contributing to the delinquency of a child, obstructing an officer, disorderly conduct and bail jumping.

They are also recommended that the alleged shooter be charged with recklessly endangering safety-1st degree (2 counts), endangering safety by use of a dangerous weapon and disorderly conduct.

According to a report by the Caledonia Police Department, numerous people reported shots being fired at 2:55 a.m. at Dec. 12 in the 2200 block of Tara Drive.

At least 25 people were armed with knives, hammers and shovels fighting in the street, according to Interim Police Chief John Barnes.

One of the suspects pointed a 9 mm Beretta at two brothers, Juan and Jaime Salazar.

According to Juan Salazar, 18, of Kenosha, Jaime and the suspect were fighting, when the suspect produced a gun from inside his coat and pointed it at Jamie. Juan said he pushed Jaime out of the way to avoid being shot. The man had fired three rounds, two at Jaime and one at him. The gunshots missed both of the brothers, and they ran to their car and fled the scene.

Jaime, 20, of Kenosha, told police the suspected pointed the gun at him within inches of his face.

"I didn't know how close I came to dying that night," he told police.

Police recovered a 9 mm gun at the scene in one of the bedrooms. Barnes said they suspect the incident was gang-related because of several texts they were able to get access to.

According to reports released by police, the homeowner's son was having his 20th birthday party when the fight started inside the residence and then spilled outside. The homeowner, had returned just prior to the fight starting, yelled to her son to wrap up the party after realizing someone had taken her kitchen knives. 

Shortly after, the homeowner's son told police he heard what sounded like someone getting hit, according to police reports. He also heard a "thump," "thump," "thump" sound outside.

Police found a compressed gas tank in the garden shed that had allegedly been used to fill multiple punch balloons and the nitrous oxide had been inhaled by some partygoers. Police also reported finding multiple cases of beer, a cooking tray with Jell-O shots, empty cellophane bags with marijuana seeds, cigars and a full box of Winchester Smith & Wesson 40-caliber hollow-point bullets.

Three other partygoers received citations. Keith Lamar Hines, 20, of Kenosha; Ian Vanderschaegen , 20, of Racine, and Krystal Morales, 18, of Kenosha, were cited for possession and consumption of alcohol
