Two Years After Accident, Formal OWI Charges Filed

A Caledonia couple was injured in an accident in Feb. 2011. The man who hit them is accused of driving under the influence.

A Delavan man accused of driving under the influence of prescription drugs when he caused a car accident that injured two people in 2011 was charged Thursday.

Court records indicate charges were files on April 10, and Angel Burgos, formerly of Milwaukee, appeared Thursday in Racine County Circuit Court to face charges of driving under the influence of a controlled substance causing injury, second or subsequent offense and operating while intoxicated causing injury, second or subsequent offense.

If convicted of both felonies, he could face up to 12 years in prison and/or up to $20,000 in fines. Because Burgos has previous OWI convictions, he could get more time tacked onto any sentence he might receive.

According to the criminal complaint, Caledonia police were called to the intersection of Highway 38 and Emmertsen Road on Feb. 11, 2011 for a report of two-car accident. When officers arrived, they found a man and a woman in a sedan and Burgos in a mini-van.

The man had to be extricated out of the vehicle and said he was suffering from back pain. Police say the woman said she had pain in her side. Both were transported to Wheaton Franciscan St. Mary's for treatment.

When officers questioned Burgos, he admitted he was taking medication for his bi-polar and depression, the complaint reads. Police put Burgos through field sobriety tests, which he failed, and transported him to Wheaton Franciscan for a legal blood draw.

Results from the state crime lab indicate Burgos had drugs in his system at the time of the accident, according to the criminal complaint.

During his initial appearance Thursday, Burgos was given a $1,000 signature bond with the conditions that he not possess or use any controlled substances and that he submit to random drug tests as well as after each court appearance.

Burgos will next be in court on May May 8.
