Police: Faux Pot Leads to Real Charges

Police say they pulled a man over for erratic driving and discovered packets of K2.

Mount Pleasant police say driving under the influence of faux pot led to very real charges of possession for one Racine man.

Trevor Chvilicek, 20, was charged Tuesday in Racine County Circuit Court with a single count each of felony possession of synthetic cannabinoid, second or subsequent offense, and misdemeanor possession of drug paraphrenalia. If convicted on both charges, he faces up to six years and 30 days in jail and/or up to $10,500 in fines. 

According to the criminal complaint, Mount Pleasant police at 7:15 p.m. Monday witnessed a car driving south on Highway 31 from Washington Avenue that was weaving from lane to lane. Officers advised dispatch before initiating the traffic stop that the driver was drifting and would then snap the car back into the correct lane as if he was falling asleep.

When police did get the driver pulled over, later identified as Chvilicek, they noted his bloodshot eyes and an overall demeanor that suggested he was under the influence of something other than alcohol. The defendant told officers he didn't take illegal drugs and that he was just tired as he drove around after work, the complaint reads.

Chvilicek was put through field sobriety tests, but the report does not indicate if he successfully performed them. The complaint also indicates the defendant was taken to Wheaton Franciscan St. Mary's for a legal blood draw, but those results were not part of the report.

Officers asked the defendant if they could look through his car, and, after obtaining permission, discovered a glass pipe commonly used to smoke marijuana. Police say they also found packets of Bizarro, or K2, a synthetic form of marijuana that is illegal in Wisconsin.

The defendant was placed under arrest for possession of the faux pot and the glass pipe. The complaint notes that at the time of his arrest, Chvilicek was on probation for intent to distribute.

He remains in the Racine County Jail on a $250 cash bond. Chvilicek will next be in court for a preliminary hearing on May 9.
