According to reports, three men were driving back to Milwaukee together after leaving a local tavern. During the drive, an argument ensued between Cruz, who was driving, and the front-passenger, Alcantara, which escalated into a physical altercation while the vehicle was still moving. Cruz was able to eventually pull over which subsequently lead to the physical altercation continuing outside of the vehicle and into the roadway.
At the time of his arrest Cruz had a warrant for his arrest out of California for Narcotic Sales. The arresting deputy gave Cruz a preliminary breath test, which returned a blood alcohol concentration of 0.15 - greater than the legal limit for drunken driving in Wisconsin, according to Sheriff's reports.
