Lawyer For Former Waukesha Alderwoman Seeks Dismissal Of Charges

WAUKESHA, WI— Donna Kuchler, an attorney for former Alderman Kathleen Cummings, filed a motion to dismiss a defective complaint on Thursday, according to online court records.

She argued the complaint failed to show probable cause that Cummings committed the charges of committed false swearing and election fraud, according to a report from the Waukesha Freeman.

Prosecutors requested extra time to review the motion, online records said.

Cummings' initial appearance is rescheduled for Dec. 10, online records said.

Cummings, who abruptly resigned as a Waukesha County Supervisor and alderman after serving for over 20 years, was charged with seven felonies after investigators found she was using two different addresses, according to online court documents and a criminal complaint.

Cummings is accused of not living in her home district for nine years of her time in public service, the complaint said. She was elected as alderman of District 9 for 20 years and as County Supervisor for District 19 for 22 years, the complaint said.
