Waukesha Teen Accused Of Bringing Guns To School Enters Plea

WAUKESHA, WI— The 19-year-old Waukesha South student accused of bringing two pellet guns to Waukesha South High School, in an incident where he was later shot and injured during a confrontation with police in December 2019, entered into a plea agreement.

Tyrone Smith appeared in Waukesha County Circuit Court on Wednesday. According to court records, Smith entered no-contest pleas to possessing a dangerous weapon at school in the first case filed in December 2019, one felony count of bail jumping in a second case filed in April 2020.

All other charges in all the cases were dismissed and considered for sentencing on April 29.

Smith was charged in 2019 with second-degree recklessly endangering safety with a dangerous weapon; resisting an officer; disorderly conduct with a dangerous weapon and possessing a dangerous weapon at school.

Police previously stated Smith had become angry at a fellow student, and brought two guns to school — both pellet guns. Police said the Waukesha South High School student approached a school resource officer, saying that Smith brought a gun to school and pointed it at another student's head.

The school resource officer and a detective ran to the classroom where Smith was and the classroom was evacuated.

Smith removed a gun from his waistband and pointed it at officers, police said. A Waukesha Police officer shot Smith a total of three times: once in the upper right thigh and in the arm twice, police said.

Smith was charged with three counts of felony bail jumping on Aug. 21. He was also charged the same day with battery, disorderly conduct, and obstructing an officer, all misdemeanor charges.
He was charged in connection to a confrontation in August with another teen. The fight was regarding a teen girl who Smith knew.

Smith has twice been charged with felony bail jumping for violating the terms of his house arrest release.

During an Aug. 26 court hearing, Smith's attorney asked the judge in the case to order a competency exam. He was later found competent for trial.
