Bay Man Takes Money for Roofing Job, But Never Follows Through on Work, Police Say

The 53-year-old Whitefish Bay man faces charges in Ozaukee County court in relation to the allegations from the Mequon condominium owners.

A Whitefish Bay man faces charges after taking money as a down payment for roofing work from owners of a side-by-side condominium in Ozaukee County – and then never doing any work on the building.

Donald Boeshaar, 53, was charged April 26 in Ozaukee County Circuit Court with two counts of theft by contractor and two counts of violating ATCP department regulations. He faces $30,000 in faces and may be imprisoned for up to 3-1/2 years.

The owners of the Mequon condominium gave Boeshaar checks in September for $2,200 each, a total of $4,400, with the understanding that it was a down payment for a roofing job, according to the criminal complaint. The work was supposed to start on Oct. 15, and be finished by the end of October.

Both homeowners said the work was never done, and attempts to reach Boeshaar for a refund were unsuccessful, the complaint said. The homeowners, with the help of an attorney, sent Boeshaar a letter demanding a refund, and he did not respond. 

Boeshaar was also found guilty of theft-business setting on two previous occasions, in 2003 and in 2004 in Milwaukee County, according to the Wisconsin Court System Circuit Court Access website; he also has a list of civil and other charges against him.

An arrest warrant was issued on April 26, and a court date has not yet been set in the case.
