Police: Brothers Argue, Mother Sustains Cut

An argument between two brothers ended with their mother sustaining a minor cut to her hand, one of the brothers in jail.

The arrested Dixon resident Jose Diaz, 21, on suspicion of assault with a deadly weapon and making threats early Saturday morning.

Police Sgt. Loren Ellefson said Diaz and his brother were at their home on the 800 block of Evans Road when they began arguing. During the argument Diaz allegedly threatened to hit his brother with cookware.

Ellefson said Diaz put the pot down and grabbed a knife from the kitchen of the home and threatened to stab his brother with it. When Diaz' mother attempted to intervene, she sustained a small cut to her hand, Ellefson said.

Police arrived at the home at 2:40 a.m., and arrested Diaz on the aforementioned charges. Ellefson explained that because Diaz threatened to cut his brother with the knife, but instead accidently cut his mother, the law enforcement principal of transferred intent applies.

Under transferred intent, intent can be transferred between victims.

Diaz was taken to Solano County Jail.
