
The family ofΒ Valeria Tachaquin Alvarado have filed a federal lawsuit following the shooting death ofΒ the mother of five last fall, claiming excessive force and wrongful death, CBS8 reported Tuesday.
Border Patrol agents were serving a warrant at a home in west Chula Vista in September 2012 when Alvarado allegedly attempted to flee in a car.Β
Last fall the Border Patrol saidΒ Alvarado tried to run over an agent in her attempt to flee.
Eyewitnesses said Alvarado's actions were not threatening the agent when shots were fired, said attorney Eugene Iredale, who is representing the family.
An investigation by the Chula Vista Police Department andΒ Department of Homeland Security Office of the Inspector GeneralΒ is ongoing, the Border Patrol said in a statement Tuesday.
