Fatal Orinda Road-Rage Shooting: DA Declines To File Charges

An incident between two men on St. Stephens Drive left one of them dead.

ORINDA, CA — The Contra Costa County District Attorney’s Office declined to file charges against an Orinda man who fatally shot another Orinda resident who punched him last fall during a road rage incident, it was announced Wednesday.

The incident happened around 11 a.m. Sept. 12, 2024, on St. Stephens Drive in Orinda. The man was driving on the roadway when he encountered Decker driving a Toyota 4Runner.

According to the DA's Office, Decker was driving slowly and moving off to the right side of the road. When the other man passed Decker, he pulled the 4Runner in front of the man's car and blocked his path.

"Decker then exited his vehicle and punched the driver three times in the face while the driver
was sitting in his vehicle," Ted Asregadoo, spokesman for the DA's Office, said. "In response to the attack, the driver, a registered gun owner with a concealed carry permit, retrieved a handgun and fired a single shot, striking Decker in the neck."

Emergency personnel responded and treated Decker, but he did not survive and was pronounced dead at the scene.

The driver's car was equipped with a camera, which captured the entire incident. The video was provided to law enforcement with the driver's consent.

After a thorough review of the evidence and the circumstances of the assault on the driver, Asregadoo said, the DA’s Office concluded no charges would be filed in the case.

The DA's Office did not disclose the driver's name Wednesday.
