Toxicology Report Says Pair Hit by Metrolink Train Weren't Drunk

Analysis answers key question surrounding Mission Viejo deaths last fall.

Anastasia Bolton and Daniel Akins weren't intoxicated when a Metrolink train plowed into them last September, a toxicology report concluded this morning.

Bolton's blood-alcohol content was .09, while Akins registered .07, according to Orange County Sheriff's Department spokesman Jim Amormino. No sign of drug use was found either.

“They weren’t drunk," the spokesman said. "At .07 you’re not even presumed to be over the influence.”

Former Mission Viejo High School student Bolton, 17, and Akins, 22, were struck and killed on the morning of Sept. 9 by a Metrolink commuter train traveling beneath the Alicia Parkway overpass.

They might have fallen asleep on the train tracks, Amormino said.

Last month, it was reported that , alleging the train crossing was unsafe.

The toxicology numbers have been falsely reported by another online publication, Amormino said.
