TWELFTH IMPLEMENTATION OF EMERGENCY RELIEF AUTHORIZED PURSUANT TO GOVERNMENT CODE SECTION 68115

2020, July 21 and 29, 2020, and August 14 and 19, 2020, upon the request of the Riverside Superior court ("Court"), Chief Justice Tani G. Cantil-Sakauye, Chair of the Judicial Council of California, exercising the authority granted under Government Code section 68115, issued emergency orders ("Orders") authorizing the Court to take certain actions pursuant to Government Code section 68115.
On September 17, 2020, upon further request made by the Court on September 11, 2020, Chief Justice Tani G. Cantil-Sakauye issued an additional emergency order authorizing the Court to take certain actions based on the determination that the conditions described in Government Code section 68115(a) continue to exist.
This Court HEREBY FINDS AND ORDERS AS FOLLOWS:
1. The Court may order that sessions be held anywhere in the county, including in correctional and juvenile detention facilities, from 9/18/2020 to 10/16/2020, inclusive, (Gov. Code, §68115(a)(l)); and
2. In cases in which the statutory deadline otherwise would expire from 9/18/2020 to 10/16/2020, inclusive, any judge of the Court may extend the time period provided in Penal Code §825 within which a defendant charged with a felony offense must be taken before a magistrate from 48 hours to not more than 4 days, (Gov. Code,§ 68115(a)(8)).
The Court reserves the authority to rescind or modify this order, as appropriate, to address changing circumstances.
THIS ORDER IS EFFECTIVE IMMEDIATELY.
