Court Decides Controversial Housing Complex Can Move Forward In Fairfield: Report
The planned 40-unit complex was filed under the state's 8-30g affordable housing provision.
FAIRFIELD, CT — A controversial, proposed four-story 40-unit apartment complex on Berkeley Road in Fairfield can move forward, following a court decision in favor of the developers, the Connecticut Post reported.
The complex, which measures more than 33,000 square feet, will be built by Berkeley Rd. LLC on three lots at 277, 291 and 301 Berkeley Road.
It was filed under the state's 8-30g affordable housing provision, and as such, 12 of the 40 units would be deemed affordable. Superior Court Judge Edward O'Hanlan reportedly issued the ruling last week.

Neighbors opposed the planned complex because of its density in an already dense area of Fairfield, which would exacerbate traffic issues.
Their arguments helped convince the Town Plan and Zoning Commission to reject the proposal, but the developers successfully appealed the denial and won in court.
