Fairfield Man Embroiled In Case Involving Possible Disbarment Of Conservator: Report
Attorney Kristan Exner, in her role as a conservator, is alleged to have sold two homes without authorization to a Fairfield businessman.
FAIRFIELD, CT — A Fairfield man is embroiled in a civil lawsuit in which an attorney and business associate of his sold him a house that was owned by a conserved person, though the attorney is alleged not to have obtained permission to sell it, The Hour reports.
Fairfield resident Joseph Garin reportedly bought the home of a former Milford woman, for whom attorney Kristan Exner served as her conservator. As the woman's court-appointed conservator, Exner controlled the woman's estate (finances) and person (medical decisions).
According to a lawsuit filed by the woman's son, who took over conservatorship duties from Exner, Exner and Garin were reportedly business associates and former college friends; the two had set up an LLC together months before the sale.

Not only did Exner sell the home without obtaining probate court approval, she sold it for less than market value to a business associate, which was a conflict of interest, according to the lawsuit.
A few months after buying the home in 2022, Garin reportedly flipped it for a profit of about $60,000.

The attorney representing the son and the conserved woman has reportedly filed a motion for Exner's disbarment.
