Fairfield's Circle Diner Battles In Court Over Eviction
The owner of the building claims the diner is behind on rent.

FAIRFIELD, CT — The popular Circle Diner, at 441 Post Road in downtown Fairfield, is battling in court to stave off eviction, as the building's owners claim the eatery is behind on rent.
In a lawsuit filed in April, 441 Post Road LLC, owners of the property, claims that FASTT, LLC d/b/a Circle Diner did not pay $18,000 in rent for March, and 441 Post Road LLC ordered FASTT to vacate the premises by March 25, which FASTT did not do.
In a reply to the lawsuit, FASTT claims it tried to pay the rent for March and subsequent months, but the owners refused to accept the payments.

The diner remains open during its regular hours. It has been at the location for more than 20 years under the ownership of Gus Tsilfides. Currently, its lease is not up until 2035.

Patch reached out to attorney Stephen Walko, who represents FASTT, and attorney Kurosh Marjani, who represents 441 Post Road LLC, for comment, but did not receive replies from either counselor.
The property, which was sold a decade ago, is slated to become a boutique hotel and 250-unit residential complex, which some neighbors opposed.
Under the initial plans, the diner building is to remain.
No court dates for the case are currently on the docket.
