Man, 66, Sexually Assaulted Girl In His Wife's Child Care Center: Jury

A jury found that the elderly husband of a child care center owner sexually assaulted a girl at the New Haven day nursery in February 2023.

NEW HAVEN, CT — A Superior Court jury found a 66-year-old New Haven man guilty of rape and risk of injury to a minor Thursday, according to New Haven Judicial District State’s Attorney John P. Doyle, Jr.

Alberto Nieves was found guilty of one count of first-degree sexual assault and one count of risk of injury to a minor, Doyle said.

According to Doyle and evidence presented at the trial, detectives with the New Haven Police Department initiated an investigation at a New Haven child care center after being contacted by the state Department of Children and Families. It was reported that a child at the center told her grandmother and mother that she had been sexually assaulted there Feb. 11, 2023 by the husband of the owner of the child care center.

Nieves will be sentenced Feb. 13, 2025 in New Haven Superior Court. First-degree sexual assault of a child in Connecticut is a Class A felony and carries a minimum of 10 years in prison.

Doyle extended his gratitude to the New Haven Police Department Special Victims Unit for their investigation of this case, and to the state Department of Children and Families and the Yale-New Haven Hospital Child Abuse Clinic for their assistance.
